Terms of Use

Effective October 11, 2026

The terms for using Catcharium and its fish identification, journal, and Pro services.

1. Your agreement with us

These Terms of Use apply to Catcharium: Fish ID & Log, its online recognition service, and this website, provided by Fria LLC ("we", "us", or "our"). By using these services, you agree to these terms. If you do not agree, do not use the services.

You must be at least 13, or the higher minimum age required where you live. If you have not reached the legal age to enter this agreement, your parent or guardian must review and agree to these terms and supervise your use.

2. App licenses and store terms

The iOS app is licensed under Apple's Standard Licensed Application End User License Agreement (EULA). These terms supplement that license for Catcharium's services; they do not replace Apple's standard EULA. If there is a conflict concerning the app license, the standard EULA controls. Apple's applicable App Store and payment terms also apply.

Fria LLC provides Catcharium and its support. Apple is not responsible for providing support for our service. Nothing here limits any rights or responsibilities that cannot be excluded under the standard EULA or applicable law.

For the Android app, we grant you a personal, non-exclusive license to use Catcharium on your compatible devices, subject to these terms and applicable Google Play terms. Google Play handles Android purchases under its store and payment terms. Fria LLC provides support for Catcharium; Google does not provide support for our recognition service. Your mandatory consumer rights remain unaffected.

3. Identification, measurement, and fishing safety

Catcharium offers photo-based species suggestions, estimated or device-assisted length measurements, a species guide, and a personal catch journal. Results are informational and may be inaccurate, incomplete, or unavailable. Similar species, poor lighting, camera perspective, depth data, and image quality can affect results. You can correct recorded lengths, but the app is not a certified measuring instrument.

Do not rely on Catcharium to determine whether an animal is safe to handle or eat, whether a species is protected, whether fishing is allowed, or whether a catch meets legal size, season, or bag limits. Consult authoritative local rules and qualified experts and use appropriate physical measurements. Follow licenses, access restrictions, conservation rules, and safe practices around water, wildlife, hooks, and equipment.

4. Your photos and catch journal

Your rights and our license. You retain your rights to your photos and catch journal. To the extent you hold the relevant rights, you grant Fria LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt, and display submitted content as needed to provide, secure, maintain, and improve Catcharium within the purposes and permissions described in our Privacy Policy. This includes recognition, image formatting and cutouts, private backup and recovery where available, support, and review of feedback you submit. We may sublicense these rights to service providers only as needed to perform those functions on our behalf, and transfer the license with a business transfer subject to the privacy protections below. This license does not transfer ownership of your content or override privacy rights, consent choices, or platform restrictions. Only submit content you have the right to use.

Fishing insights. If you separately opt in to the fishing-insights program described in the Privacy Policy, the license also permits us to analyze the covered records and create genuinely anonymous, aggregated insights for the disclosed research, product-development, and commercial purposes. We may develop, publish, license, and charge for those anonymous outputs without compensation to you, subject to applicable law and any separate agreement. This does not authorize sale of personal information or publication of identifiable photos, private journals, or individual precise catch locations. Our own AI training using private photos or records requires the separate opt-in described in the Privacy Policy.

Duration and deletion. The content license lasts only as needed for the permitted purposes and applicable retention periods. Withdrawal of consent or deletion limits further processing as explained in the Privacy Policy. Rights in lawfully created anonymous aggregates that cannot reasonably be linked back to you may continue after deletion or the end of your use; this does not extend retention of identifiable source records. Necessary legal retention and processing to complete deletion remain subject to the Privacy Policy.

Saved catches remain on your device. Where cloud backup is available, they can also be backed up to an anonymous account, and submitted scans that are not saved as catches are scheduled for cleanup after 90 days from server-record creation. Recovery depends on a completed backup and retaining access to that same account. We do not currently offer account linking or guaranteed recovery after changing devices or losing credentials. Keep independent copies of photos that matter to you.

5. Free access, Pro, and purchases

Some features are available without payment, subject to the limits shown in the app. Catcharium Pro may be offered as a monthly or annual auto-renewing subscription or as a one-time lifetime purchase. Available plans, included features, prices, currencies, billing periods, and any introductory offers are shown before you confirm a purchase. The Apple App Store or Google Play purchase sheet controls the final price and billing terms.

  • Payment is charged through your Apple Account or Google Account when you confirm the purchase, subject to any trial or offer displayed by that store.
  • Subscriptions renew automatically unless canceled under the store’s displayed terms. For Apple subscriptions, cancel at least 24 hours before the current period ends; Apple may charge within the preceding 24 hours. For Google Play subscriptions, cancel before the next renewal to stop the next charge.
  • You can manage or cancel subscriptions in your Apple Account or Google Play subscription settings. Cancellation ordinarily takes effect at the end of the paid period. Deleting Catcharium or emailing us does not cancel a store subscription.
  • If a free trial or introductory offer is available, its eligibility, duration, and price after the offer are disclosed at purchase. Any unused trial portion may be forfeited when you purchase a subscription, as provided by the applicable store’s terms.
  • A lifetime purchase is a one-time, non-renewing purchase of the advertised Pro access for the operating life of Catcharium. It does not promise that the service will operate forever or include separate future products. Your mandatory consumer rights remain unaffected.
  • Use Restore Purchases in the app with the Apple Account or Google Account that made the purchase to recover eligible access. Refund requests are handled through Apple at reportaproblem.apple.com, subject to Apple’s rules and applicable law. For Google Play purchases, use Google Play’s refund process or contact us for assistance, subject to Google’s rules and applicable law.

Subscription and purchase status is verified using the relevant store and RevenueCat. Refunded, revoked, or expired purchases may no longer provide Pro access. We will honor applicable notice, consent, refund, and consumer-law requirements when changing paid offerings.

6. Appropriate use and availability

Use the service lawfully and for its intended purpose. Do not bypass purchase checks or usage limits, automate abusive request volumes, interfere with the service, attempt unauthorized access, or infringe others' rights. Restrictions on reverse engineering apply only to the extent permitted by law and the app license.

Recognition requires an internet connection and depends on third-party services. Temporary rate limits, maintenance, outages, or provider changes may affect availability. Pro access does not remove reasonable security controls. We may restrict access when reasonably necessary to address abuse, security, or legal requirements and will provide notice when practicable.

7. Ownership and third-party services

Except for your content and third-party materials, Catcharium's software, design, branding, species-guide organization, analytics methods, and other materials belong to Fria LLC or its licensors. To the extent intellectual-property or database rights exist, we own the rights in the original datasets, statistical compilations, reports, models, and other outputs we create through the lawful uses described in these terms and the Privacy Policy. We may exploit and license those rights commercially. This does not give us ownership of your original content, exclusive ownership of facts or public fishing locations, or permission to retain or disclose personal information outside the Privacy Policy. Your right to use the app is governed by the license described above. Third-party materials remain subject to their applicable licenses.

Apple, RevenueCat, cloud providers, and external websites may have their own terms. Our Privacy Policy explains the providers used to process information for Catcharium.

8. Warranties and responsibility

To the extent permitted by law, the service is provided as available, without a promise that all identifications or measurements will be correct or that access will be uninterrupted. Fria LLC is not responsible for decisions made solely on an unverified AI result.

To the extent permitted by law, we exclude liability for indirect or consequential losses arising from use of the service. These terms do not exclude or limit liability for fraud, willful misconduct, gross negligence, death or personal injury where such liability cannot be excluded, or any other non-excludable liability. They do not remove statutory warranties, refund rights, or other mandatory consumer protections.

9. Ending use and changes

You can stop using Catcharium at any time. Manage any active subscription separately through Apple or Google Play. Content deletion and privacy requests are explained in the Privacy Policy.

We may update features or these terms. We will post the updated terms with a new effective date and provide appropriate notice of material changes. Changes will not retroactively remove accrued rights or expand permissions for previously submitted private content solely because new terms were posted. Where required, we will seek your agreement before a change takes effect. Required privacy consent is separate from agreement to these terms. If we discontinue a paid service, applicable consumer rights and any required remedies continue to apply.

10. Applicable law and contact

These terms are governed by the laws of Wyoming, United States, except that mandatory protections and rights to bring claims in your home jurisdiction remain available where applicable. If a provision is unenforceable, the remaining terms continue to apply to the extent permitted by law.
